Paid Leave Oregon Updates: New Employee Guidebook

Paid Leave Oregon has posted an Employee Guidebook to walk people through the types of leave they can take, how their benefits will be calculated, what documentation they will have to provide, and what they can expect after they apply. Notably, employees can start applying for benefits effective August 14, 2023, so long as they will have a qualifying event beginning or ongoing as of September 3, 2023. A June 20, 2023 email announcement from Paid Leave Oregon indicates that benefit payments will be released no later than two weeks after an employee’s claim is reviewed and processed, but it does not suggest how long the review process will take to complete.

CORRECTION: Our previous Alert regarding changes to OFLA to harmonize with Paid Leave Oregon has been corrected to read that effective immediately (subject to a 60-day advance notice to employees prior to making a change), the OFLA benefit year can either be calculated the same as Paid Leave Oregon (the 52 weeks beginning on the Sunday immediately preceding the leave) or another consecutive 12-month period (whatever the employer is currently using). Effective July 1, 2024, OFLA’s benefit year must be calculated the same as Paid Leave Oregon.
