“How the Biden NLRB Impacts Employers”
This session will address matters under the federal National Labor Relations Act (”NLRA”) and therefore under the jurisdiction of the National Labor Relations Board (“NLRB”) and the federal courts, ultimately the U.S. Supreme Court. These are directly related to the practice of law, involving advice and representation to employers involving virtually all facets of managing their workforces to be in compliance with the law. This also includes the legal issues related to union organizing, union elections, collective bargaining, contract interpretation, discipline of employees who may be covered by a union contract or be engaged in “protected concerted activity” under the NLRA, strikes and picketing. This area of labor law is constantly evolving and legal practitioners who work in this area should be aware of and updated on developments from the NLRB and the courts.
“Update on Hawaii and Federal Employment Law Developments”
This session will provide an update on state and federal developments in the employment law area, to include legislative developments, administrative (particularly the federal Equal Employment Opportunity Commission and Department of Labor and the Hawaii Department of Labor and Industrial Relations, including the Hawaii Civil Rights Commission) guidance and enforcement, and judicial decisions. Awareness of developments in the law, the interpretation of the law, and administrative enforcement of the law is critical for practitioners to properly advise clients, whether in transactional or litigation matters.
“Demystifying the Bermuda Triangle: ADA, FMLA, and Workers’ Compensation Protections for Medical Leaves”
The topic involves analysis of the Americans with Disabilities Act (“ADA”), the Family and Medical Leave Act (“FMLA”), and the Hawaii Fair Employment Practices Law (“FEPA”), and how these laws potentially interact with each other. For instance, when an employee needs medical leave especially in excess of their accrued paid leave, there may need to be a legal analysis as to whether the leave is protected under the ADA, FMLA, and/or FEPA and if so for how long (which in turn affects whether and when the employer may lawfully terminate the employee), and whether the employer has other or alternative accommodation obligations under the ADA.

With a background in offensive security consulting, Mr. Tippett leverages his unique experience to support Aon customers on both proactive and reactive cybersecurity initiatives. He has a strong belief that cybersecurity needs to be better aligned with the overall risk management strategy of companies and believes that Aon has the unique experience to help support that mission.
